Apel Kongresu Kobiet do Parlamentu EU

Kongres Kobiet – jeden z największych ruchów społeczno-politycznych w Polsce i za granicą – którego celem jest walka:

- o pełne równouprawnienie Kobiet i mężczyzn (tak w sferze ekonomicznej, politycznej, zdrowotnej jak i prywatnej)

- o uznanie praw reprodukcyjnych kobiet jako praw człowieka

- o uznanie praworządności oraz europejskiego systemu wartości na których opiera się doktryna praw człowieka

zwraca się z apelem do reprezentantów ustawodawczej i wykonawczej władzy Wspólnoty Europejskiej o uznanie praw reprodukcyjnych, w tym prawa do aborcji, jako elementu

prawodawstwa obowiązującego wszystkie kraje członkowskie.

Ograniczenie praw kobiet (praw zdrowotnych, prawa do bezpieczeństwa) do jurysdykcji narodowej doprowadziło do dramatycznych skutków: rządząca w Polsce partia a także Kościół systematycznie pozbawiały nas prawa do autonomii utrzymując najbardziej restrykcyjną ustawę antyaborcyjną w Europie a obecnie doprowadziły do sytuacji, w której wyrok Trybunału Konstytucyjnego nakazującego kobietom utrzymywać ciąże z wadami embriopatologicznymi płodu i donosić ciąże letalne spowodował, że kobiety w Polsce nie tylko zostały pozbawione praw do samostanowienia ale zostały skazane na tortury.

Jako proeuropejska i prodemokratyczna organizacja zajmująca się prawami kobiet nie dajemy na to swojej zgodny. Jednak uważamy, że bez wsparcia Wspólnoty Europejskiej, bez uznania praw reprodukcyjnych jako elementu europejskiej, obowiązującej praworządności – nie uda nam się ochronić kobiet. Brak praw reprodukcyjnych, a więc brak prawa do autonomii, samostanowienia, integralności cielesnej kobiet jak również brak skutecznej, instytucjonalnej ochrony przed przemocą (Konwencja Rady Europy dotycząca przeciwdziałania przemocy wobec kobiet i przemocy w rodzinie została wprawdzie ratyfikowana ale jest bojkotowana przez obecne władze w Polsce) powoduje, że kobiety są w Polsce obywatelkami drugiej kategorii co jest sprzeczne z egalitaryzmem praw unijnych.

Dlatego domagamy się uznania praw reprodukcyjnych wszystkich kobiet – obywatelek Unii

Europejskiej jako elementu podstawowych praw człowieka i niezbędne kryterium sprawiedliwości i praworządności w państwach UE.

Congress of Women – one of the largest social and political movements in Poland and abroad that was set up to fight:

– for fully equal rights of women and men (in the realm of economics, politics and health as well as in the private realm)

– for considering the reproductive rights of women as human rights

– for recognising the rule of law and the European system of values on which the human rights

doctrine is based –

appeals to the representatives of the legislative and executive authorities of the European Union to recognise reproductive rights, including the right to abortion, an element of legislation obligatory in all member states.

The limitation of women’s rights (health rights, the right to security) to national jurisdiction has led to dramatic consequences: the party ruling in Poland as well as the Catholic Church have systematically deprived us of the right to autonomy, supporting Europe's most restrictive anti-abortion act, and most recently produced a situation in which the verdict of the Constitutional Court that forces women to keep their pregnancies with congenital defects and carry them until term even if the foetus is moribund not only stripping the women in Poland of their right of self-determination but also sentences them to torture.

As a pro-European and pro-democratic organisation championing the rights of women, we do not concede to that. However, we believe that without the support of the European Union, without recognising the reproductive rights as an element of the binding European rule of law, we won’t manage to protect women. Lack of reproductive rights – and consequently the lack of the right to autonomy, self-determination, bodily integrity of women, as well as lack of efficient institutional protection against violence, as the Convention on Counteracting Violence Against Women and Domestic Violence of the Council of Europe might have been ratified, yet it is boycotted by the current Polish government – makes women in Poland citizens of a lower class, which defies the egalitarian nature of EU laws.

That is why we demand the recognition of the reproductive rights of all the women – citizens of the European Union – as an element of fundamental human rights and a mandatory criterion of justice and rule of law in EU member states.
